Disse betingelser gælder for Lullabee Aps, for de abonnementer der tilbydes på Lullabee, og de produkter der leveres i henhold til abonnementer. Ved køb af ydelser på Lullabee App, accepterer du disse abonnements- og handelsbetingelser og indvilliger i at følge dem.

1) PRODUKTET
Lullabee er en App med en tilhørende abonnementsløsning, hvor man får adgang til Lullabees soveunivers. Når du downloader og sætter kryds i, at du accepterer abonnements- og handelsbetingelser, accepterer du betingelserne i denne aftale, og de efterfølgende ændringer, som måtte blive gennemført. Du kan til enhver tid opsige aftalen i henhold til de betingelser der gælder for opsigelse.
2) PRISER
Gældende priser og eventuelle gebyrer, er til enhver tid angivet på Lullabee App. Der tages forbehold for trykfejl. Alle priser er inklusive moms. Vi forbeholder os ret til at ændre evt. priser og forsendelsesomkostninger. Du er bundet af de priser, der gælder på det tidspunkt, du har tegnet dit abonnement, medmindre vi giver dig besked om prisændringer, og du ikke inden for 20 dage fra den dato, hvor meddelelsen er sendt, meddeler, at du ikke accepterer sådanne ændrede vilkår. Herved vil abonnementet blive opfattet som opsagt.
3) BETALING
Ved indgåelse af dit abonnement accepterer du at betale den månedlige abonnementspris, indtil abonnementet opsiges. Ved køb giver du automatisk Lullabee Aps lov til løbende, at trække abonnementsbeløbet fra dit kredit- eller betalingskort uden yderligere godkendelse. Abonnementsbeløbet trækkes automatisk fra dit betalingskort, Via Google Store/Apple Store den sidste bankdag i måneden.
4) BRUG AF ABONNEMENTET
Når du opretter en profil, er den til dit personlige brug, samt de personer, som du aktivt knytter til profilen via deling gennem enheder. Profilen må ikke udlånes til andre. App’en må ikke bruges til at ulovligt eller strafbart indhold, og Lullabee forbeholder sig retten til til enhver tid at lukke din brugerkonto, såfremt du handler i strid med disse abonnements- og handelsbetingelser, Lullabees øvrige regler for brug af app’en eller gældende dansk ret. Såfremt vi vælger at lukke brugerprofilen, er det ikke muligt at få refunderet penge for allerede betalt abonnementsperiode.
5) OPSIGELSE AF ABONNEMENT
Opsigelse kan ske når som helst, der er ingen binding.
For at opsige dit abonnement hos Lullabee Aps bedes du gå ind på din profil på AppStore og GooglePlay og afmelde under abonnementer. Du kan altid kontakte os på [email protected] hvis du har behov for hjælp.
6) LEVERINGSTIDSPUNKT- OG TRANSPORT
Levering sker til kundens smartphone eller tablet, hvor appen installeres. Varen leveres straks efter købets gennemførelse.
Familie deling på op til 4 enheder er muligt.
7) ERSTATNING OG FORCE MAJEURE
Lullabee er ikke erstatningsansvarlig overfor dig eller tredjemand for indirekte skader eller følgeskader, for tab af data eller andet, hvordan det end måtte være forårsaget, selvom et sådant tab eller en sådan skade kunne forudses af Lullabee eller Lullabee var gjort opmærksom på, at muligheden for tab eller skade, forelå. I tilfælde af at Lullabee ikke kan overholde sine forpligtelser i henhold til denne aftale, og dette skyldes forhold, som Lullabee ikke er herre over, og som Lullabee ikke med rimelighed kunne forudse, er Lullabee ikke ansvarlig herfor. Aftaler indgået med andre i forbindelse med download og brug af app’en, eksempelvis Google eller Apple, indgås som selvstændige aftaler, som Lullabee ikke kan gøres ansvarlig for.
8) REKLAMATION
Eventuelle fejl eller mangler ved produkter/varer leveret gennem abonnementsordningen skal påberåbes indenfor 14 dage efter det købte. Det er kundens ansvar at undersøge købte. Det er din pligt at angive, og på forlangende vise, hvordan fejlen eller manglen ytrer sig. Dersom du opdager en fejl, skal du rette henvendelse til Lullabee på [email protected].
Lullabee betaler ikke for udgifter som kan komme på kundens initiativ iværksatte tiltag, for at udbedre fejl og mangler, såfremt det ikke er aftalt med Lullabee Aps.
9) FORTRYDELSESRET
Det er ikke muligt for kunden at fortryde aftalen, den er gældende fra den dag ordren er afsendt, dog kan abonnementet opsiges med det samme, da der ingen binding er.
10) OPLYSNINGSPLIGT
Aftaler (købsordrer) kan indgås på dansk eller engelsk og opbevares af virksomheden i 5 år, i henhold til bogføringsloven. De til enhver tid gældende handelsbetingelser vil fremgå af app’en.
11) PROCEDUREN FOR FORNYELSE OG SLETNING AF KORTNUMMER (FX. HVIS KUNDEN SKIFTER KORT)
Betaling foregår gennem Apple/Google, og deres betalingsbetingelser er gældende for betaling for abonnementet til Lullabee Aps.
Hvis det eksisterende kort ikke længere er gyldigt, kan der ikke trækkes yderligere betalinger og abonnementet stopper dermed. Der kan tilføjes et gyldigt kort via dit Apple ID eller Google Store.
12) OPLYSNING OM KORTINDEHAVERS ANSVARS- OG HÆFTELSESFORHOLD
For at sikre abonnementsbetalingernes gennemførsel og dermed levering af ordren, er det op til kunden at sørge for, at kortet er aktivt. Hvis betalingskortet er udløbet eller bortkommet, kan der oprettes en ny abonnementsordre, med et nyt betalingskort. Det gamle abonnement stopper automatisk ved udløb af ordren.
13) OPLYSNING OM KRITERIERNE (BETINGELSERNE) FOR AT GENNEMFØRE TRÆK PÅ KUNDENS KORTNUMMER
Der gennemføres træk på kundens betalingskortnummer i overensstemmelse med det beløb der er handlet for igennem abonnementsordningen. Der kan aldrig trækkes mere end det angivne beløb 35 kr.
14) OPLYSNING OM HVORDAN KVITTERING LEVERES/STILLES TIL RÅDIGHED
Ved gennemførelse af køb af abonnement gælder handelsbetingelser hos Appstore/Google Play.
15) RETTIGHEDER
Lullabee Aps ejer alle immaterielle rettigheder til Lullabee meditationer og Lullabee historier og alle materialer lagt ud på Lullabee app og Lullabee.dk hjemmeside samt dennes Facebook og Instagram mv. Disse rettigheder og materialer er beskyttet af copyright og enhver ret i denne forbindelse forbeholdes. Såfremt du kommenterer, uploader billeder eller deler anden info om Lullabee, eller vores sociale medier, giver du os en uigenkaldelig ret til at citere fra disse, eller dele mellem platformene.
De materialer, som du selv måtte uploade via app’en i din profil tilhører dig, og kan ikke tilgås eller bruges af Lullabee Aps. Du har selv ansvar for at sikre dig, at materialet ikke krænker andres rettigheder.
Lullabee Aps har en aftale med Koda i forhold til materiale, som du kan tilgå som abonnent. Denne aftale dækker ikke din brug af andres immaterielle rettigheder. Dog vil brugen af andres immaterielle rettigheder på din egen profil ikke udgøre en krænkelse af deres rettigheder, da der ikke vil ske distribution til en større kreds.
16) ÆNDRINGER af Vilkår & Betingelser
Lullabee Aps kan til enhver tid foretage tilføjelser eller ændringer til disse vilkår. Du er bundet af de priser, der gælder på det tidspunkt, du har tegnet dit abonnement, med mindre vi giver dig besked om prisændringer, og du ikke inden for 20 dage fra den dato, hvor meddelelsen er sendt meddeler, at du ikke accepterer sådanne ændrede vilkår. Herved vil abonnementet blive opfattet som opsagt.

1) PRODUCT
Lullabee is an App with an associated subscription solution, where you get access to Lullabee’s sleeping universe. By downloading and checking that you accept the subscription and trade terms, you accept the terms of this agreement and any subsequent changes that may be made. You can terminate the agreement at any time in accordance with the conditions that apply to termination.
2) PRICES
Current prices and any fees are stated at any time on the Lullabee App. Reservations are made for printing errors. All prices include VAT. We reserve the right to change prices and shipping costs. You are bound by the prices that apply at the time you have subscribed to your subscription, unless we notify you of price changes, and if you do not, within 20 days from the date on which the notice is sent, notify us that you do not accept such changed terms. Hereby, the subscription will be perceived as terminated.
3) PAYMENT
By entering into your subscription, you agree to pay the monthly subscription price until the subscription is terminated. Upon purchase, you automatically give Lullabee Aps permission to regularly deduct the subscription amount from your credit or debit card without further approval. The subscription amount is automatically deducted from your debit card, Via Google Store / Apple Store on the last banking day of the month.
4) USE OF THE SUBSCRIPTION
When you create a profile, it is for your personal use, as well as the people you actively associate with the profile via sharing through devices. The profile may not be lent to others. The app may not be used for illegal or criminal content, and Lullabee reserves the right to close your user account at any time if you act in violation of these subscription and trading conditions, Lullabee’s other rules for use of the app conflicting Danish legal system. If we choose to close the user profile, it is not possible to get a refund for money already paid for the subscription period.
5) TERMINATION OF SUBSCRIPTION
Termination can take place at any time, there is no binding.To cancel your subscription with Lullabee Aps, please go to your profile on the AppStore and GooglePlay and unsubscribe under subscriptions. You can always contact us at [email protected] if you need help.
6) DELIVERY TIME AND TRANSPORT
Delivery takes place to the customer’s smartphone or tablet, where the app is installed. The item is delivered immediately after the purchase is completed.
Family sharing of up to 4 units is possible.
7) REPLACEMENT AND FORCE MAJEURE
Lullabee shall not be liable to you or any third party for any indirect or consequential damages, loss of data or any other cause whatsoever caused, even if such loss or damage could be foreseen by Lullabee or Lullabee was made aware that the possibility of loss or damage was present. In the event that Lullabee fails to comply with its obligations under this Agreement, and this is due to circumstances over which Lullabee has no control and which Lullabee could not reasonably foresee, Lullabee is not liable for it. Agreements entered into with others in connection with the download and use of the app, such as Google or Apple, are entered into as independent agreements for which Lullabee cannot be held responsible.
8) COMPLIANT
Any errors or defects in products / goods delivered through the subscription must be reported within 14 days of the purchase. It is the customer’s responsibility to examine purchases. It is your duty to state and, on request, show how the error or defect manifests itself. If you discover an error, please contact Lullabee at [email protected].
Lullabee does not pay for expenses that may arise on the customer’s initiative initiated measures, to rectify errors and deficiencies, unless it has been agreed with Lullabee Aps.
9) RIGHT OF WITHDRAWAL
It is not possible for the customer to cancel the agreement, it is valid from the day the order is sent, however, the subscription can be terminated immediately, as there is no binding.
11) DUTY TO DISCLOSURE
Agreements (purchase orders) can be entered into in Danish or English and kept by the company for 5 years, in accordance with the Accounting Act. The terms and conditions applicable at any given time will appear in the app.
12) THE PROCEDURE FOR RENEWAL AND DELETION OF CARD NUMBER (IF THE CUSTOMER CHANGES CARD)
Payment is made through Apple / Google, and their payment terms apply to payment for the subscription to Lullabee Aps.
If the existing card is no longer valid, no further payments can be deducted and the subscription will stop. A valid card can be added via your Apple ID or Google Store.
13) INFORMATION ON CARD HOLDER’S RESPONSIBILITY AND LIABILITY
To ensure the completion of the subscription payments and thus the delivery of the order, it is up to the customer to make sure that the card is active. If the payment card has expired or been lost, a new subscription order can be created, with a new payment card. The old subscription automatically stops when the order expires.
14) INFORMATION ON THE CRITERIA (CONDITIONS) FOR IMPLEMENTING THE CUSTOMER’S CARD NUMBER
Withdrawals are made to the customer’s payment card number in accordance with the amount purchased for the subscription. No more than the stated amount can be deducted

15)INFORMATION ON HOW RECEIPT IS DELIVERED / AVAILABLE
When completing the purchase of a subscription, trading conditions at Appstore / Google Play apply.
16) RIGHTS
Lullabee Aps owns all intellectual property rights to Lullabee meditations and Lullabee stories and all materials posted on the Lullabee app and Lullabee.dk website as well as its Facebook and Instagram etc. These rights and materials are protected by copyright and all rights in this regard are reserved. If you comment, upload photos or share other info about Lullabee, or our social media, you give us an irrevocable right to quote from these, or share between the platforms.
The materials that you may upload via the app in your profile belong to you and cannot be accessed or used by Lullabee Aps. You are responsible for ensuring that the material does not infringe the rights of others.
Lullabee Aps has an agreement with Koda in relation to material that you can access as a subscriber. This agreement does not cover your use of the intellectual property rights of others. However, the use of the intellectual property rights of others on your own profile will not constitute a violation of their rights, as there will be no distribution to a larger circle.
17) CHANGES TO TERMS AND CONDITION
Lullabee Aps may make additions or changes to these terms at any time. You are bound by the prices that apply at the time you have subscribed to your subscription, unless we notify you of price changes, and you do not within 20 days from the date on which the notice is sent notify you that you do not accept such changed terms.
